All webpages on the domain name www.cacwa.org.au collectively comprise “the Chamber website’, the website of the Chamber of Arts and Culture WA.
These Terms and Conditions apply to your use of the Chamber of Arts and Culture WA website, including any pages, resources, member areas, directories, online forms, event listings, downloadable materials, forums and other digital services made available through the website.
By accessing or using this website, you agree to these Terms. If you do not agree, you should not use the website.
1. About the Chamber
This website is operated by The Chamber of Arts and Culture WA Incorporated (the Chamber, we, us or our), a Western Australian incorporated association.
The Chamber is the peak body for the arts and cultural sector in Western Australia.
2. Other terms that may apply
These Terms should be read together with:
- our Privacy Policy;
- our Membership Application Terms and Conditions;
- the Chamber’s Rules of Association;
- any event, ticketing, donation, sponsorship, partnership or program terms that apply to a specific transaction or activity; and
- any terms of use that apply to third-party platforms used to deliver parts of the website.
If there is an inconsistency between these Terms and a specific agreement you have entered into with the Chamber, the specific agreement will apply to the extent of the inconsistency. For members, the Chamber’s Rules of Association prevail over these Terms to the extent required by law or the Rules.
3. Changes to these Terms
We may update these Terms from time to time.
Changes will take effect on the date the updated Terms are published on the website, unless we state otherwise. If a change materially affects paid services, memberships or member benefits during a current paid period, we will take reasonable steps to notify affected users and apply the change fairly.

- sell them or commercially exploit them as standalone products;
- remove copyright notices or source acknowledgements;

- imply that the Chamber endorses your organisation, campaign, position or publication unless we have agreed in writing; or

- publishes content that may cause harm to Aboriginal and Torres Strait Islander people, communities, families or cultural custodians, including culturally restricted material or material used without appropriate permission; or

You may be able to submit, upload or publish content through the website, including member directory profiles, event listings, comments, forum posts, resources, images, logos, documents or other materials (User Content).
You are responsible for your User Content.
By submitting User Content, you confirm that:
- the content is accurate to the best of your knowledge;
- you have all rights, permissions, licences and consents needed to submit and publish it;
- the content does not infringe copyright, moral rights, trade marks, privacy, confidentiality, cultural permissions or any other rights;
- the content is not defamatory, misleading, deceptive, discriminatory, unlawful or harmful; and
- where the content includes Aboriginal and Torres Strait Islander cultural material, names, images, voices, stories, knowledge or community material, you have obtained appropriate cultural permissions.
You grant the Chamber a non-exclusive, royalty-free licence to host, reproduce, publish, communicate, adapt, crop, format and otherwise use your User Content for the purpose of operating, administering, moderating, promoting and archiving the website, member directory, Chamber activities and related communications.
9. Moderation and removal of content
We may review, edit, decline, remove, hide or disable access to User Content where we reasonably consider that the content:
- breaches these Terms;
- breaches the Chamber’s Rules of Association or member obligations;
- may expose the Chamber or another person to legal risk;
- is inaccurate, outdated, inappropriate or harmful;
- may compromise website security or operation; or
- is inconsistent with the Chamber’s role, values, reputation or obligations.
We are not required to monitor all User Content, but we may do so.
10. Member directory and member forums
The website may include a member directory, member profiles, discussion forums or other member-only areas.
Unless clearly stated otherwise, directory listings and forum posts are provided by members or users, not by the Chamber.
The Chamber does not endorse, verify or guarantee the products, services, events, views or claims made by members or other users.
You must not use member directory information for unsolicited marketing, scraping, list-building, harassment, political campaigning, unrelated commercial promotion or any purpose not connected with the affairs of the Chamber or the arts and cultural sector.
11. Intellectual property
Copyright is reserved to the Chamber of Arts and Culture WA and all rights are reserved.
Unless otherwise stated, the Chamber either owns the intellectual property rights in this website, or the Chamber has obtained the permission of the owner of the intellectual property in such content to use the content on the Chamber website.
You may view, download and print website content for personal, internal organisational, educational, advocacy or non-commercial sector purposes, provided you keep all copyright and source acknowledgements intact.
Except as expressly permitted by these Terms or by law, you must not copy, reproduce, adapt, publish, communicate, distribute, commercialise, frame, mirror, republish or exploit website content without our prior written permission.
The Chamber’s name, logos and branding must not be used without our written permission.

17. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
Consumer guarantees under the Australian Consumer Law apply automatically to goods and services supplied to consumers, and businesses must not mislead consumers about these rights. The ACCC also states that terms and conditions cannot take away consumer rights and that unfair contract term laws protect consumers and small businesses in standard form contracts.
To the extent permitted by law, where the Chamber is liable for a failure to comply with a consumer guarantee in relation to services, our liability may be limited to supplying the services again or paying the cost of having the services supplied again.

We aim to keep the website secure and available, but we do not guarantee uninterrupted, error-free or virus-free access.
We may suspend, withdraw, restrict or change all or part of the website for maintenance, upgrades, security, operational reasons or legal compliance.

This responsibility is reduced to the extent the loss was caused or contributed to by the Chamber.
